Lawsuit filed against Cuomo over WNY Psych Center

BUFFALO, N.Y. -- A lawsuit against Gov. Cuomo is the latest move in the fight over the future of the Western New York Children's Psychiatric Center.

A coalition working to keep it open is suing the governor and the state's mental health commissioner. Their goal is to stop the state's plan to close the West Seneca facility and send kids to the Buffalo Psychiatric Center, where adults are treated.

Lawmakers unanimously passed a bill last month to prevent the closure, but there's been no decision from the governor.

Steve Cohen, the attorney for the coalition, says the state's Mental Hygiene Law does not allow the administration to shut down the WNY CPC without the backing of the legislature.

Cuomo was in Buffalo on Thursday, and said he's still waiting for the bill to be presented to him. He'll then consider whether to sign or veto it.
